1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and JC Software Insights (KvK 99941945, registered at Overschiestraat 170, 1062XK Amsterdam, Netherlands), operating the SaaS product known as ChampionTracker. By accessing or using ChampionTracker, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Service Description
ChampionTracker is a B2B sales-intelligence tool that automates the tracking of professional job changes. It uses publicly available professional data and licensed third-party APIs to detect when a tracked contact moves between companies.
3. User Obligations and Acceptable Use
- Right to Process. You warrant that you have the legal right, under all applicable laws (including the GDPR and CAN-SPAM Act), to upload, track, and contact the individuals in your lists.
- No Spam. You agree not to use inferred email addresses to send unsolicited, unlawful, or bulk commercial email.
- Lawful Purpose. You may only use the platform for legitimate B2B sales, recruiting, customer success, or networking purposes.
- No Reverse Engineering. You will not attempt to reverse-engineer, decompile, scrape, or otherwise abuse the platform or its APIs.
4. Limitations of Liability and Accuracy
- No Guarantee. ChampionTracker provides data (including job changes and inferred emails) on an "as-is" and "as-available" basis. We do not guarantee 100% accuracy, completeness, or deliverability of inferred emails.
- Liability Cap. To the maximum extent permitted by the Netherlands law, our aggregate liability is limited to the amount you paid us for the service in the 12 months preceding the claim.
5. Subscription and Payments
Services are billed on a recurring subscription basis via Stripe. Fees are non-refundable except where required by law. We reserve the right to change pricing with at least 30 days' notice. Credits expire according to the rollover policy described in your billing dashboard.
6. Termination
You may cancel your subscription at any time from the billing portal. We reserve the right to suspend or terminate your account if you violate these Terms, particularly the Acceptable Use policy (e.g., we receive abuse complaints regarding outreach you sent based on data found through our platform).
7. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
