1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and JC Software Insights (KvK 99941945, VAT number NL005420117B29, registered at Overschiestraat 170, 1062XK Amsterdam, Netherlands), operating the SaaS product known as ChampionTracker. By accessing or using ChampionTracker, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Service Description
ChampionTracker is a B2B sales-intelligence tool that automates the tracking of professional job changes. It uses publicly available professional data and licensed third-party APIs to detect when a tracked contact moves between companies.
3. User Obligations and Acceptable Use
- Right to Process. You warrant that you have the legal right, under all applicable laws (including the GDPR and CAN-SPAM Act), to upload, track, and contact the individuals in your lists.
- No Spam. You agree not to use inferred email addresses to send unsolicited, unlawful, or bulk commercial email.
- Lawful Purpose. You may only use the platform for legitimate B2B sales, recruiting, customer success, or networking purposes.
- No Reverse Engineering. You will not attempt to reverse-engineer, decompile, scrape, or otherwise abuse the platform or its APIs.
4. Limitations of Liability and Accuracy
- No Guarantee. ChampionTracker provides data (including job changes and inferred emails) on an "as-is" and "as-available" basis. We do not guarantee 100% accuracy, completeness, or deliverability of inferred emails.
- Liability Cap. To the maximum extent permitted by the Netherlands law, our aggregate liability is limited to the amount you paid us for the service in the 12 months preceding the claim.
5. Subscription and Payments
Subscriptions are billed monthly in advance via Stripe. Prices are shown excluding VAT, with the price including VAT next to them. Consumers and customers in the Netherlands pay VAT; businesses in another EU country with a valid VAT number are charged without VAT (reverse charge). We reserve the right to change pricing with at least 30 days' notice.
Each plan includes monthly action credits. They refill every month on the day of the month you signed up (for example on the 12th); monthly credits you don't use don't carry over. Purchased credit packages never expire and are used after the monthly credits. Actions that deliver nothing (an email that can't be found or validated) give their credits back.
When you cancel, your plan stays active until the end of the period you paid for. Fees are non-refundable, except as described in section 6 or where the law requires otherwise.
If you move to a plan with room for fewer champions than you track, your oldest champions stay tracked up to the new limit and the others are paused: they keep their data but get no automatic checks until you upgrade or remove champions. Paid actions still work on paused champions.
6. Right of Withdrawal (EU Consumers)
If you are a consumer in the EU, you may withdraw from a subscription within 14 days of taking it out, without giving a reason. Because you ask for the service to start right away when you pay, you then pay only for the days up to your withdrawal, and we refund the rest within 14 days to your original payment method.
Credit packages are delivered immediately. When you buy one, you agree to that immediate delivery and accept that your right of withdrawal ends once the credits have been added to your account.
To withdraw, send a clear statement to contact@championtracker-insights.com before the 14 days have passed, for example using this model form:

7. Termination
You may cancel your subscription at any time from the billing portal. You may also ask us to delete your account; your subscription then ends at once and the days already paid for are not refunded, except as described in section 6. We reserve the right to suspend or terminate your account if you violate these Terms, particularly the Acceptable Use policy (e.g., we receive abuse complaints regarding outreach you sent based on data found through our platform).
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
